Terms and Conditions – Elyséa HEALTH

Elyséa Health is operated by Elyséa Health Pty Ltd (referred to as “Elyséa Health”, “we”, “us” or “our”). These Terms and Conditions govern your access to and use of our website, booking system, clinical services, and related offerings. By accessing our website, booking an appointment, or receiving services from Elyséa Health, you agree to be bound by these Terms and Conditions, together with our Privacy Policy.
Definitions
- “Elyséa Health” means Elyséa Health Pty Ltd and its associated services.
- “Clinician” means psychiatrists, psychologists, general practitioners, or other registered health professionals providing care through Elyséa Health.
- “Client” or “you” means any person receiving or booking services through Elyséa Health.
- “Services” means consultations, assessments, therapy, medical care, reports, and any other healthcare or administrative support provided by our Clinicians.
- “Clinic” refers to our physical premises in Adelaide, where in-person appointments are held.
Nature of Our Services
- In-person consultations at our premium Adelaide clinic
- Coordinated care across psychiatry, psychology, and general practice
Booking and Appointments
- The personal and health information you provide is accurate and complete
- You understand the nature and scope of the service being requested
- You agree to the consultation fees as quoted at the time of booking
Fees, Billing, and Medicare
All services are privately billed. Fees are set by individual Clinicians and will be advised before you confirm your booking. Elyséa Health administration staff will provide a clear fee estimate in advance.
- Medicare rebates are available for eligible services when you have a valid referral (e.g., Mental Health Treatment Plan from a GP or specialist referral).
- DVA cardholders may be bulk-billed for certain services where Clinicians have elected to do so.
- Additional fees may apply for:
- Late cancellations or non-attendance
- Administration tasks (e.g., preparing reports for third parties)
- Changes to appointments on short notice
Fees are subject to change without prior notice. Full payment is required at the time of booking or on the day of consultation unless otherwise arranged.
Your Responsibilities
You agree to:
- Provide accurate and complete health information to your Clinician
- Attend appointments on time
- Follow recommended management plans and liaise with your referring GP or other treating practitioners as advised
- Advise us promptly of any changes to your contact details or health status that may affect your care
Limitations of Our Services
Elyséa Health is not an emergency or crisis service. Our Services are designed for non-urgent mental health and general medical care.
If you are experiencing a mental health crisis, suicidal thoughts, or any situation requiring immediate attention, you must:
- Call 000 (emergency services)
- Contact Lifeline on 13 11 14
- Attend your nearest hospital emergency department
- Call your local mental health crisis team
Our Clinicians do not admit patients to the hospital, provide crisis intervention, or replace emergency care.
Not Medical Advice
Information on our website and general materials are provided for educational purposes only and do not constitute medical advice. All clinical advice, diagnosis, treatment recommendations, and prescribing decisions are made solely by your treating Clinician during your consultation.
Elyséa Health is not responsible for the clinical decisions or outcomes of care provided by independent Clinicians.
Privacy and Confidentiality
We are committed to protecting your privacy in accordance with the Australian Privacy Principles and relevant health records legislation. Personal and health information is collected, used, stored, and disclosed only as permitted by law and as outlined in our Privacy Policy (available on our website).
Complaints
If you have concerns about your Clinician or the clinical care received, please raise them directly with your treating Clinician in the first instance. You may also contact:
- The Australian Health Practitioner Regulation Agency (AHPRA)
- Your state Health Complaints Commissioner or Ombudsman
For concerns about our administrative services, website functionality, or booking process, please email us at admin@elyseahealth.com.au with sufficient detail. We will investigate promptly and aim to respond within 30 days.
No Abuse Policy
We maintain a safe and respectful environment. Abusive, threatening, or intimidating behaviour toward staff, Clinicians, or other clients is not tolerated. We reserve the right to refuse service, cancel appointments, or terminate access to our services in such cases.
Disclaimer and Limitation of Liability
To the maximum extent permitted by law:
- Elyséa Health provides the website and administrative services “as is” without warranties of any kind
- We are not liable for any direct, indirect, consequential, or special damages arising from use of our Services, including outcomes of clinical care provided by independent Clinicians
- We are not responsible for the acts, omissions, or clinical decisions of individual Clinicians
Nothing in these Terms excludes or limits rights under the Australian Consumer Law that cannot be excluded.
Amendments
We may update these Terms at any time. The current version is published on our website. Your continued use of our Services constitutes acceptance of any changes.
Governing Law
These Terms are governed by the laws of South Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia.
By booking an appointment or using our website, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
